Terms & Conditions

A. Scope & Application
1. These Terms & Conditions (“Terms”) set out the agreement between you (“you”, “your”) and Sea Travel & Tours Sdn. Bhd. (“we”, “us”, “our”).
2. They apply whenever you use our website www.seatravel.my (“Site”) or engage our services for travel-arrangements, including bookings.
3. By using the Site or booking through us, you accept these Terms in full. If you disagree, please do not proceed.

B. Definition of Terms
• Sea Travel & Tours means Sea Travel & Tours Sdn. Bhd., company registration no. 197701000123 (31069-H).
• Services refers to travel products or arrangements we provide or arrange (e.g. flights, hotels, packaged tours, etc.).
• Booking means your confirmed reservation of Services from or through us.
• Price(s) means the total cost payable for your booking as stated or calculated at the point of confirmation.

C. Your Responsibilities & Warranties
You represent and warrant that:
1. You are at least 18 years old.
2. You are legally capable of entering binding contracts.
3. You will provide accurate, up-to-date and complete information.
4. You agree to use our Site and Services lawfully and in alignment with these Terms.

D. Pricing, Payment & Confirmation
1. All charges are in Malaysian Ringgit (RM) unless stated otherwise.
2. Final price may include taxes, applicable fees or surcharges. We will inform you of all known costs before you confirm booking.
3. Payment methods accepted: [credit/debit cards, online bank transfer (FPX), etc.].
4. Confirmation of your booking occurs only when we receive full payment and send a booking confirmation email.
5. If payment is not cleared within the time we specify, we reserve the right to cancel your booking.

E. Tour Operator Liability
1. Sea Travel & Tours is not the operator of external service providers (carriers, hotels, tour guides, etc.). While we aim to appoint reputable suppliers, we do not control their operations.
2. We shall not be liable for:
o Injuries, illness, or accidents during travel.
o Delays, cancellations, or changes caused by external circumstances (e.g. weather, regulation changes, force majeure).
o Loss theft or damage of personal items.
3. It is your responsibility to procure adequate travel insurance to cover medical, cancellation, loss or other travel risks.

F. Reservation Refusal & Change
1. We reserve the right to refuse or cancel any booking at our discretion, including for reasons such as:
o Incorrect or misleading information.
o Non-payment or payment issues.
o Unavailability of the Service.
2. Booking changes requested by you may incur fees. Any changes are subject to these Terms and to terms of the relevant Service or supplier.

G. Limitations, Disclaimers & Liability Cap
1. Our Site and Services are provided on an “as is, as available” basis. We make no promise of error-free operation or that the Site will work without interruptions.
2. To the extent permitted by law, we exclude all implied warranties (fitness for purpose, merchantability, non-infringement).
3. Our total liability for any claim arising out of or in connection with these Terms or your use of our Site or Services is limited to RM5000.00 only.

H. Travel & Documentation Requirements
1. You must ensure you hold valid passports, visas, vaccinations or permits required by airlines, immigration and other authorities.
2. We cannot be held responsible if you are denied entry, transit, or boarding due to missing or invalid documentation.

I. Force Majeure
We shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to natural disasters, pandemics, war, industrial action, or governmental restrictions.

J. Governing Law & Dispute Resolution
1. These Terms are governed by Malaysian law.
2. All disputes arising under or in connection with these Terms must be resolved in the courts of Malaysia.
3. Claims must be commenced within two (2) years from the date the cause of action accrues, or the claim will be time-barred.
